General Terms and Conditions

1. Scope

These terms and conditions apply to all orders placed through our online shop at sora-shop.com (including our online configurators). They apply to consumers and to business customers alike; where a provision applies to consumers only, this is stated. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contracting party and customer service

The contract is concluded with sorashowcases.com, owner Sebastian Koch, Am Schunkenhofe 11, 99848 Wutha-Farnroda, Germany. Further details can be found in our Legal Notice. For questions, complaints and claims, our customer service can be reached by e-mail at info@sorashowcases.com; we usually reply within one working day.

3. Conclusion of contract

The presentation of products in our shop and the prices calculated by our configurators do not constitute a binding offer on our part; they are an invitation to you to place an order.

By clicking the order button at the end of the checkout you submit a binding offer to purchase the items in your basket. Before doing so you can review and correct your entries at any time on the checkout page. Immediately after you have placed your order, you will receive our order confirmation by e-mail; with this e-mail we accept your offer and the contract is concluded.

We check every order after receipt. If our check shows that an order is based on an obvious error, on a technical fault, or on data that were altered or entered in a way not provided for by our shop, whatever the cause, or that it cannot be manufactured as entered, we may withdraw from the contract within two working days of your order. We will inform you without delay and refund any payment already made. Our statutory rights, in particular the right to avoid a contract for mistake or deception, remain unaffected.

4. Prices and shipping costs

All prices are total prices in euro. For deliveries within the European Union they include the statutory value added tax. For deliveries to countries outside the European Union (for example Switzerland, Norway or Great Britain; Northern Ireland is treated like an EU delivery), item prices are calculated without German VAT (tax-free export delivery); import VAT, customs duties and any clearance fees of the destination country are payable by you to the carrier or the authorities on delivery and are not included in our prices.

Shipping costs are charged once per order, irrespective of the number and weight of the items. The shipping charge for your delivery country is shown on our Shipping & Payment page and again at the checkout before you place your order.

5. Delivery

We deliver to Germany, to the other member states of the European Union listed on our Shipping & Payment page, and to the further European countries and territories listed there (among them Switzerland, Norway, Great Britain and Northern Ireland). For France, Greece, Italy, Portugal and Spain, delivery excludes islands and special delivery areas. Delivery is by parcel or freight service only; collection in person is not possible.

Unless stated otherwise on the product page, items are manufactured and dispatched within approx. 8 working days. Where payment in advance by bank transfer has been chosen, this period begins when your payment is received. If we are unable to deliver within this period, we will inform you of the expected delivery date.

6. Payment

You can pay by PayPal (including credit or debit card payment through PayPal; a PayPal account is not required for card payments) or by bank transfer in advance. If you choose bank transfer, we will e-mail you our bank details with the order confirmation; manufacture begins and the goods are dispatched once your payment has been received. If payment is not received within 14 days, we may withdraw from the contract.

7. Made-to-measure items

Made-to-measure items are items that we manufacture individually to the specifications you provide. Please note:

  • Where relevant, the product pages explain which measurements are required and how to take them. You are responsible for the correctness of your specifications; we manufacture exactly to your entries and do not check them against their intended use.
  • Manufacturing tolerances of up to 1 mm per dimension apply. Acrylic glass expands and contracts with temperature, so the size of a panel at the time of cutting can differ slightly from its size in your home. Deviations within this tolerance do not constitute a defect. Please allow for it when choosing your dimensions.
  • Made-to-measure items are manufactured to your specifications and are therefore excluded from the statutory right of withdrawal (section 312g(2) no. 1 BGB). Details, and what we can do for you as a voluntary service if you notice a mistake in your specifications, are set out on our Right of Withdrawal page.
  • Changes to an order after it has been placed are possible only as long as the order has not yet been scheduled for production. Please contact us immediately by e-mail.

8. Retention of title

The goods remain our property until they have been paid for in full.

9. Transport damage

If goods are delivered with obvious transport damage, please report the damage to the carrier immediately if possible, photograph the damage and the packaging, and contact us without delay. Failure to make a complaint or to contact us has no consequences for your statutory rights, in particular your warranty rights; it does, however, help us to assert our own claims against the carrier or the transport insurer.

10. Warranty and liability

The statutory warranty rights apply. For consumers, the limitation period for claims arising from defects is two years from delivery of the goods. We also supply individual replacement panels for all our products, beyond the warranty period, at the prices calculated by our spare parts configurator.

The warranty covers defects that exist at the time of delivery. It does not cover damage resulting from improper use, handling or care – in particular from cleaning with solvent-based, alcohol-based or abrasive cleaning agents, which attack the surface of acrylic glass and cause clouding or stress cracks; from exposure to excessive heat or direct sunlight over long periods; from mechanical damage after delivery; or from assembly other than as described in our instructions. Please clean acrylic glass only with a soft, damp cloth and water or a cleaner expressly made for acrylic.

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and for damage arising from the breach of a guarantee. For the slightly negligent breach of an essential contractual obligation – an obligation whose fulfilment is a prerequisite for the proper performance of the contract and on whose fulfilment you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. This limitation also applies in favour of our employees and agents.

11. Right of withdrawal

Consumers have a statutory right of withdrawal for ready-made products. The instructions on withdrawal, the model withdrawal form and the exclusion for made-to-measure items are set out on our Right of Withdrawal page.

12. Storage of the contract text

We store the text of the contract and send you the order data and these terms and conditions by e-mail with the order confirmation. You can view and print the current terms and conditions on this page at any time. Your past orders can be viewed in your customer account.

13. Applicable law and contract language

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence. The language available for the conclusion of the contract is English.

This shop, these terms and all contract documents are provided in English only. Translations displayed by your browser or by translation services (for example Google Translate) are generated automatically by third parties; we do not provide or check them and accept no responsibility for their content. Only the English text is authoritative.

14. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (section 36 VSBG).
